Agency terms

These terms are between AdStck ("we", "us") and the marketing agency creating an account ("you"). By ticking the box at signup you agree to them on behalf of your agency. If you are not authorised to bind your agency, do not create the account.

What AdStck is

Software for building and running enquiry funnels for the businesses you work with ("your clients"). It hosts the funnels, stores the enquiries they produce, sends confirmation emails, and — where you configure it — passes enquiry events to advertising platforms.

Your clients' data

You decide what your funnels collect and what happens to it. In data protection terms you and your clients are the controllers; AdStck is your processor. Our obligations as your processor are in the data processing agreement, which forms part of these terms.

You are responsible for having a lawful basis for what your funnels collect, for the accuracy of anything you publish through AdStck, and for your clients' relationship with the people who fill in their forms.

Templates and generated documents

AdStck can fill in privacy policies, cookie policies and terms of use from a template and your client's details. These are a starting point, not legal advice. They have not been reviewed by a solicitor for your client's circumstances. You are responsible for reviewing them before they are published and for their accuracy once they are. We record who published each version and when.

Tracking and consent

Where you connect a Meta pixel, a Google tag, or similar, AdStck loads it only after a visitor has consented through the consent banner, and sends server-side events only for visitors who consented. You must not attempt to bypass, disable, or reduce the prominence of the consent controls. Doing so ends your right to use the service and is a breach of these terms.

Your account

Keep your login secure. You are responsible for everything done under your account, including by your staff and your clients' portal users. Tell us at once if you think it has been compromised.

Acceptable use

You will not use AdStck to send unsolicited marketing, to collect data you have no right to collect, to publish false or misleading content, or in any way that breaks the law where you or your clients operate. We may suspend an account that does.

Fees

Fees are as shown when you subscribed or as agreed in writing. We may change them with 30 days' notice. Unpaid fees may result in suspension.

Availability and support

We aim for the service to be available at all times but do not guarantee it. We will tell you in advance about planned maintenance where we can.

Ending

Either of us may end this agreement on 30 days' written notice. On ending, your access stops; your clients' data is handled as the DPA describes.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything the law does not allow to be limited.

Beyond that, our total liability to you in any 12-month period is limited to the fees you paid us in that period. We are not liable for loss of profit, business, or data, or for any indirect loss. We are not liable for the content of documents you publish through the service, including generated documents you chose not to review.

You will indemnify us against claims arising from your funnels' content, your clients' use of the service, or your breach of these terms.

Changes

We may update these terms. We will tell you by email at least 30 days before a material change takes effect. Continuing to use the service after that date means you accept the new version. Your original acceptance and its date are recorded against the version you accepted.

Law

These terms are governed by the laws of England and Wales and any dispute goes to the courts of England and Wales.
